Use of Retentions & Implications of UKG Commercial Payments Bill

Retention payments have been part of construction for decades, but they remain one of the industry’s most debated commercial practices. With the UK Government considering significant reforms through the Commercial Payments Bill including a potential ban on retentions this is an opportunity for you, in the built environment to help shape the future of payment practices in the sector.

CEWales, on behalf of Welsh Government, is seeking your urgent insight to:

  • Establish the extent and nature of retention practices in Welsh public sector construction contracts;
  • Assess the impacts of the use of retentions on the supply chain, particularly SMEs; and
  • Gather stakeholder views on the potential impacts of the UK Government’s Commercial Payments Bill (including a proposed ban on retentions).

The research will inform Welsh Government policy, procurement guidance, dialogue with UK Government, and potential amendments to the model social public works clauses published under the Social Partnership and Public Procurement (Wales) Act 2023 (SPPPA).
